In these Terms and Conditions:

• “Easy Print Hub” means Easy Print Hub Pty Ltd.
• “Contracting Party” means any individual, corporation, or legal entity that orders any Goods or services offered and supplied by Easy Print Hub.
• “Goods” means any goods provided to the Contracting Party by Easy Print Hub or procured by Easy Print Hub for the Contracting Party, including printing proofs (both conceptual and final), and any printed materials or artwork.
• “Job” means all Goods and/or services to be supplied to the Contracting Party, as described on the Tax Invoice, Quotation, or any other forms provided by the Contracting Party to Easy Print Hub.
• “Price” means the price payable for the Goods and/or services as agreed between the Contracting Party and Easy Print Hub, and specified in the Quotation.
• “Quotation” means a written quotation for the Goods and/or services to be provided to the Contracting Party by Easy Print Hub.

1. Quotation

1.1 Easy Print Hub will only commence work on an Order after:

(a) A written Quotation has been issued based on the information provided by the Customer;

(b) The Customer has accepted the Quotation, including by signing and returning it via email or by any other method approved by Easy Print Hub;

(c) Any required non-refundable deposit (if specified in the Quotation) has been received. Where payment is made by cheque, production will not commence until the cheque has been successfully cleared.

1.2 By accepting the Quotation, the Customer acknowledges that they have read, understood, and agreed to be bound by these Terms and Conditions.

1.3 All Quotations are prepared based on the information, artwork, and specifications provided by the Customer. If any changes are requested after the Quotation has been issued, Easy Print Hub reserves the right to revise the quoted price accordingly. The Customer is responsible for reviewing and confirming that all details contained in the Quotation are accurate before accepting it.

1.4 Unless otherwise stated, a Quotation remains valid for thirty (30) days from the date of issue. After this period, Easy Print Hub reserves the right to amend or withdraw the Quotation without notice.

1.5 Easy Print Hub reserves the right to correct any typographical, clerical, pricing, or other errors contained in a Quotation at any time before the Order is completed.

1.6 Any request for alterations, amendments, revisions, or additional work after the Customer has accepted the Quotation may incur additional charges. Such charges will be calculated in accordance with Easy Print Hub’s current hourly design or production rates, or any other rates notified to the Customer, and will be payable in addition to the original quoted price.

2. Artwork and Print Jobs

2.1 All artwork, designs, files, and other materials (whether in electronic or other formats) supplied by the Customer must comply with Easy Print Hub’s file specifications. Easy Print Hub is not responsible for any file-related errors, including issues affecting print quality, where the files provided are incomplete, incorrect, or not print-ready.

2.2 Unless otherwise agreed in writing, all artwork and files supplied by the Customer are deemed to be final, approved, and print-ready. Easy Print Hub is not obliged to inspect, edit, correct, or verify such files before production.

2.3 Any additional design, artwork preparation, file conversion, editing, translation, programming, or other work required to prepare Customer-supplied files for production will be charged at Easy Print Hub’s current hourly rates or such other rates as notified to the Customer.

2.4 Hard copy samples, printed materials, or physical artwork supplied by the Customer will not be used as colour references or colour-matching standards unless expressly agreed in writing.

2.5 While Easy Print Hub takes reasonable care to achieve consistent colour reproduction, variations in colour may occur between print runs, reprints, paper stocks, materials, printing processes, and between the front and reverse sides of printed products. Such variations are considered normal within the printing industry, and Easy Print Hub accepts no liability for these differences.

2.6 Any preliminary work, concept development, proofs, samples, prototypes, test prints, or experimental work carried out at the Customer’s request shall be deemed part of the Services and will be charged accordingly unless otherwise agreed in writing.

2.7 The Customer warrants that all instructions, approvals, amendments, and requests relating to an Order will be provided in writing, including by email or any other communication method accepted by Easy Print Hub. Easy Print Hub will not be liable for any errors, omissions, delays, or misunderstandings arising from verbal instructions or handwritten directions that are unclear, incomplete, or incorrectly interpreted.

3. Pricing and Payment Terms

3.1 Unless otherwise stated, all prices quoted by Easy Print Hub are in Australian Dollars (AUD) and are exclusive of Goods and Services Tax (GST). GST will be charged where applicable and will be separately itemised on the relevant tax invoice.

3.2 The Customer agrees to make payment in accordance with the payment terms specified by Easy Print Hub and set out in the relevant tax invoice, unless a separate credit arrangement has been approved in writing by Easy Print Hub.

3.3 Unless otherwise agreed in writing, all tax invoices are payable within thirty (30) days from the date of issue.

4. Late Payment

4.1 If any amount remains unpaid after the due date, Easy Print Hub reserves the right to charge interest on the outstanding balance, including any applicable design, production, or other service charges.

4.2 The Customer agrees to indemnify Easy Print Hub for all reasonable costs, expenses, legal fees, and debt recovery charges incurred in recovering any overdue amounts owed by the Customer.

5. Suspension of Services

5.1 Easy Print Hub reserves the right to suspend or delay production or the performance of any Services where the value of work completed exceeds the amount of any deposit or payments received from the Customer.

5.2 Easy Print Hub may also suspend the performance of any Order if the Customer fails to pay any amount owing to Easy Print Hub, whether relating to the current Order or any previous Order.

5.3 If the Customer requests that work be suspended for any reason for a period of thirty (30) days or more, Easy Print Hub shall be entitled to invoice the Customer for all work completed and costs incurred up to the date of suspension.

5.4 An Order may not be cancelled once production has commenced except with the written agreement of Easy Print Hub. The Customer remains liable for all work completed, materials used or specially ordered, and any other costs reasonably incurred by Easy Print Hub up to the date of cancellation.

6. Privacy

6.1 Easy Print Hub is committed to protecting the privacy of its Customers and complies with the Privacy Act 1988 (Cth) and any applicable Australian privacy laws. Any personal information collected in connection with an Order or the provision of Services will be collected, used, stored, disclosed, and managed in accordance with those laws and Easy Print Hub’s Privacy Policy.

6.2 Where Easy Print Hub provides the Customer with any personal information in connection with an Order or these Terms and Conditions, the Customer agrees to handle that information in compliance with the Privacy Act 1988 (Cth) and all other applicable privacy laws, and to use such information only for the purpose for which it was provided.

7. Credit Reporting and Credit Information

7.1 Where the Customer applies for or is granted a commercial credit account with Easy Print Hub, the Customer authorises Easy Print Hub to obtain credit information and credit reports from any authorised credit reporting body or credit provider for the purpose of assessing the Customer’s creditworthiness and managing the credit account.

7.2 The Customer authorises Easy Print Hub to exchange credit-related information with credit reporting bodies, financial institutions, trade referees, debt collection agencies, and other credit providers where permitted by law for the purposes of:

(a) Assessing an application for commercial credit;

(b) Reviewing or monitoring an existing credit facility;

(c) Recovering overdue amounts;

(d) Notifying or confirming payment defaults; and

(e) Assessing the Customer’s ongoing creditworthiness.

7.3 The Customer acknowledges that any personal or commercial credit information collected or disclosed by Easy Print Hub will be handled in accordance with the Privacy Act 1988 (Cth), applicable Australian privacy laws, and Easy Print Hub’s Privacy Policy.

7.4 Where the Customer fails to make payment by the due date, Easy Print Hub may disclose information relating to the overdue account to a credit reporting body or debt collection agency to the extent permitted by law.

7.5 The Customer consents to Easy Print Hub retaining and using credit information for the purposes of administering the Customer’s account, processing payments, recovering outstanding debts, and any other purpose authorised by law.

8. Retention of Title

8.1 Legal and beneficial ownership of all Goods supplied by Easy Print Hub remains with Easy Print Hub until the Customer has paid in full all amounts owing to Easy Print Hub in respect of the relevant Order and any other amounts due under these Terms and Conditions.

8.2 Until ownership of the Goods passes to the Customer:

(a) the Customer must hold the Goods as bailee for Easy Print Hub;

(b) the Customer must store the Goods separately and ensure they remain clearly identifiable as the property of Easy Print Hub;

(c) the Customer must not pledge, charge, or otherwise deal with the Goods in any manner that may prejudice Easy Print Hub’s ownership rights; and

(d) Easy Print Hub may, without prior notice and to the extent permitted by law, enter any premises where the Goods are reasonably believed to be located to recover possession of the Goods if payment has not been made when due.

8.3 Where the Customer sells or otherwise disposes of the Goods before title has passed, the Customer does so as principal and not as agent of Easy Print Hub, and the proceeds of sale shall be held on trust for Easy Print Hub to the extent of any amount owing.

8.4 Easy Print Hub may require the Customer to assign to Easy Print Hub any rights or claims the Customer has against a third party arising from the sale of the Goods to the extent necessary to recover any outstanding amounts, and the Customer agrees to execute any documents reasonably required to give effect to that assignment.

9. General Lien

9.1 Ownership of the Goods will not pass to the Customer until Easy Print Hub has received full payment of all amounts owing.

9.2 Any claim relating to the Goods or Services, including shortages, defects, or damage, must be notified to Easy Print Hub in writing within seven (7) days after delivery or collection of the Goods.

10. Delivery

10.1 Delivery of the Goods is deemed to have occurred when:

(a) the Goods are delivered to the delivery address nominated by the Customer;

(b) the Goods are collected by the Customer or the Customer’s authorised representative from Easy Print Hub’s premises;

(c) the Goods are delivered to a carrier nominated by the Customer.

10.2 Unless otherwise agreed in writing, delivery, freight, handling, insurance, and any associated transport costs are payable by the Customer and may be included in the Customer’s invoice.

10.3 The Customer must ensure that appropriate arrangements are made to receive or collect the Goods at the agreed time. If delivery cannot be completed due to the Customer’s failure to accept delivery or provide access, Easy Print Hub may charge the Customer for any additional storage, handling, or redelivery costs incurred.

10.4 Any delivery dates or estimated completion times provided by Easy Print Hub are estimates only and are not guaranteed. Easy Print Hub will use reasonable endeavours to meet estimated delivery dates but will not be liable for any loss, damage, cost, or delay arising from circumstances beyond its reasonable control, including delays caused by suppliers, freight carriers, equipment failure, labour shortages, severe weather, or other unforeseen events.

10.5 Risk in the Goods passes to the Customer upon delivery or collection, regardless of whether ownership has passed in accordance with these Terms and Conditions.

11. Returns, Defects and Remedies

11.1 The Customer must inspect the Goods immediately upon delivery or collection and notify Easy Print Hub in writing within seven (7) days of any alleged defect, shortage, damage, or failure of the Goods or Services to comply with the accepted Quotation or approved artwork.

11.2 If the Customer fails to provide written notice within the period specified in clause 12.1, the Goods and Services will be deemed to have been accepted by the Customer.

11.3 If Easy Print Hub determines that a defect or non-conformity is the result of its workmanship or production process, Easy Print Hub may, at its sole discretion:

(a) repair the Goods;

(b) replace the Goods;

(c) re-perform the relevant Services; or

(d) refund the price paid for the affected Goods or Services.

These remedies constitute the Customer’s exclusive remedy for any accepted claim.

11.4 Easy Print Hub is not required to accept the return of any Goods that have been used, installed, altered, damaged by the Customer or a third party, or are custom-made or produced in accordance with the Customer’s specifications.

12. Warranties and Limitation of Liability

12.1 Where Easy Print Hub is entitled by law to limit its liability for a breach of a statutory guarantee, its liability is limited, at Easy Print Hub’s option, to one or more of the following:

(a) repairing the Goods;

(b) replacing the Goods;

(c) supplying equivalent Goods or Services;

(d) re-performing the Services; or

(e) paying the reasonable cost of repairing, replacing, or re-supplying the Goods or Services.

12.2 To the maximum extent permitted by law, Easy Print Hub shall not be liable for any indirect, incidental, special, punitive, or consequential loss or damage, including but not limited to loss of profits, loss of revenue, loss of business opportunities, production delays, loss of data, or any other economic loss arising out of or in connection with the Goods, Services, or these Terms and Conditions.

13. Payment and Information Security

13.1 Easy Print Hub is committed to protecting the security of the Customer’s personal information and payment details. Reasonable technical and organisational measures are implemented to safeguard information submitted through the Easy Print Hub website and other communication channels.

13.2 Online payments are processed through secure payment systems provided by trusted third-party payment service providers. Easy Print Hub does not store full payment card details unless required by law or expressly authorised by the Customer.

13.3 While Easy Print Hub takes reasonable steps to protect information transmitted electronically, no method of transmission over the Internet or electronic storage is completely secure. Accordingly, Easy Print Hub cannot guarantee absolute security.

13.4 Easy Print Hub will only use or disclose the Customer’s personal information in accordance with its Privacy Policy and applicable Australian privacy laws.

13.5 Marketing communications will only be sent where the Customer has consented to receive them or where otherwise permitted by law. Customers may unsubscribe from marketing communications at any time.

14. Intellectual Property and Copyright

14.1 Unless otherwise agreed in writing, all intellectual property rights, including copyright, in any artwork, designs, layouts, proofs, concepts, marketing materials, or other creative works created by Easy Print Hub remain the exclusive property of Easy Print Hub, even if the Customer has paid for the Goods or Services.

14.2 The Customer warrants that it owns, or has obtained all necessary rights, licences, and permissions to use and authorise Easy Print Hub to reproduce, modify, print, publish, or otherwise use any artwork, logos, images, text, trademarks, or other materials supplied by the Customer for the purposes of fulfilling the Order.

14.3 The Customer indemnifies and holds harmless Easy Print Hub against any claim, loss, liability, damage, cost, or expense (including legal costs on a full indemnity basis) arising from any allegation that materials supplied by the Customer infringe the intellectual property rights or other legal rights of any third party.

14.4 Easy Print Hub may use photographs or images of completed work for its portfolio, website, social media, marketing, or promotional purposes unless the Customer notifies Easy Print Hub in writing before production that such use is not permitted.

15. Electronic Files and Design Files

15.1 Unless otherwise agreed in writing, all working files, source files, editable artwork, production files, and design files created by Easy Print Hub, including but not limited to Adobe Illustrator (AI), InDesign (INDD), Photoshop (PSD), EPS, and other editable formats, remain the exclusive property of Easy Print Hub.

15.2 The Customer will normally receive only the final production-ready files or deliverables specified in the accepted Quotation. Easy Print Hub is not obliged to provide editable or source files.

15.3 If the Customer requests editable artwork, source files, or conversion of files into another format, Easy Print Hub may, at its sole discretion, agree to provide such files subject to payment of any applicable release fee, licence fee, design fee, or other charges determined by Easy Print Hub.

15.4 Any amendments, redesign, file conversion, or recreation of completed artwork requested after completion of the Order will be charged at Easy Print Hub’s current hourly design rates unless otherwise agreed in writing.

16. Termination

16.1 Easy Print Hub may immediately suspend or terminate any Order, Services, or credit arrangement by written notice if the Customer:

(a) Becomes insolvent or is unable to pay its debts as they fall due;

(b) Enters into any arrangement or compromise with creditors;

(c) Has a receiver, administrator, liquidator, trustee, or other external controller appointed over any of its assets or business;

(d) Becomes bankrupt or, if an individual, is subject to bankruptcy proceedings; or

(e) Ceases or threatens to cease carrying on business.

16.2 Upon termination or suspension under this clause:

(a) All outstanding amounts owing to Easy Print Hub become immediately due and payable;

(b) Easy Print Hub may cease performing any further Services or delivering any Goods; and

(c) termination does not affect any rights or remedies accrued by either party before the date of termination.

17. General

17.1 Severability

If any provision of these Terms and Conditions is found to be invalid, illegal, or unenforceable, that provision shall be read down or severed to the minimum extent necessary, and the remaining provisions shall continue in full force and effect.

17.2 No Waiver

A failure or delay by Easy Print Hub in exercising any right or remedy under these Terms and Conditions does not constitute a waiver of that right or remedy.

17.3 Governing Law

These Terms and Conditions are governed by the laws of the State of Western Australia. The parties submit to the non-exclusive jurisdiction of the courts of Western Australia and any courts entitled to hear appeals from those courts.

17.4 Assignment

These Terms and Conditions are binding upon the Customer and its successors, permitted assigns, executors, administrators, and legal representatives.

17.5 Amendments

Easy Print Hub may amend these Terms and Conditions from time to time. Updated Terms and Conditions will be published on the Easy Print Hub website and will apply to all Orders placed after the effective date of publication, unless otherwise agreed in writing.

17.6 Entire Agreement

These Terms and Conditions, together with any accepted Quotation and any documents expressly incorporated by reference, constitute the entire agreement between Easy Print Hub and the Customer in relation to the Goods and Services and supersede all prior discussions, negotiations, representations, and agreements relating to the same subject matter.

17.7 Force Majeure

Easy Print Hub is not liable for any delay or failure to perform its obligations where such delay or failure results from events beyond its reasonable control, including natural disasters, fire, flood, pandemic, industrial disputes, supply chain disruption, government action, or failure of transport or communication services.
